Agreement to Terms
By accessing or using the Destiny Wells for Congress website (“the Site”), submitting any form on the Site, making a donation, signing up to volunteer, or receiving communications from the Campaign, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the Site or submit any information to the Campaign.
These Terms should be read in conjunction with our Privacy Policy, which is available here and describes how we collect, use, and protect your personal information.
Eligibility
The Site is publicly accessible and may be viewed by anyone. However, you must be at least 13 years of age to submit personal information to the Campaign through the Site, including through volunteer sign-up forms, contact forms, email sign-ups, or any other data collection mechanism. If you are under 18, you should only submit personal information with the involvement and consent of a parent or guardian.
By making a donation, you certify that you meet all eligibility requirements under federal campaign finance law, including that you are a United States citizen or lawful permanent resident, that the donation is made from your own funds and not from a corporate or foreign source, and that you are not a federal government contractor.
Use of the Website
The Site is provided for informational purposes related to the campaign of Destiny Wells for Congress. You agree to use the Site only for lawful purposes and in a manner consistent with these Terms.
You agree not to:

Use the Site in any way that could damage, disable, or impair its operation or interfere with any other party’s use of the Site

Attempt to gain unauthorized access to any part of the Site, its servers, or any systems connected to the Site

Use any automated system, including bots, scrapers, or crawlers, to access the Site for any purpose without the Campaign’s express written permission

Donations
Donations to the Campaign are processed through ActBlue, a third-party payment processor. All donations are subject to ActBlue’s own terms of service and privacy policy, which are presented during the donation process. The Campaign does not directly store credit card or bank account information on its systems.
Donations to the Campaign are subject to federal contribution limits and reporting requirements as set forth by the Federal Election Commission (FEC). Donor information, including name, address, occupation, and employer, may be publicly reported as required by law for contributions exceeding applicable disclosure thresholds. Contributions are not tax-deductible for federal income tax purposes.
Volunteer Activities
By signing up to volunteer through the Site or any Campaign form, you agree to provide accurate contact information and understand that the Campaign may use this information to coordinate volunteer activities with you, including by email, phone, or text message as described in our Privacy Policy.
Volunteers act in a voluntary capacity and are not employees, agents, or representatives of the Campaign unless expressly designated as such in writing. The Campaign is not responsible for any injuries, damages, or losses incurred during volunteer activities except as required by applicable law.
The Campaign reserves the right to accept, decline, or discontinue any volunteer’s participation at its sole discretion.
Text Messaging and Communications
The Campaign may communicate with you via text message (SMS and MMS), email, phone, or other channels based on the contact information you provide. By providing your phone number to the Campaign, you consent to receive text messages from Destiny Wells for Congress, including updates, event invitations, and voting reminders.

Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, images, photographs, videos, and software, is the property of the Campaign or its content providers and is protected by applicable copyright, trademark, and other intellectual property laws.
You may share Campaign content on social media or other platforms for non-commercial, campaign-supportive purposes, provided you do not alter the content or misrepresent its source. Any other use of Campaign content requires express written permission.
The Campaign name, logo, and all related marks are trademarks of the Campaign. Unauthorized use of these marks is prohibited.
User-Submitted Content
By submitting any content to the Campaign through the Site, social media, email, or other channels — including testimonials, photographs, videos, or written endorsements — you grant the Campaign a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and distribute such content for campaign-related purposes.
You represent that any content you submit is your own original work or that you have the necessary rights and permissions to share it, and that it does not violate any third party’s rights.
Third-Party Links and Services
The Site may contain links to third-party websites or services, including payment processors, social media platforms, and email marketing providers. These third-party services are governed by their own terms of use and privacy policies, which the Campaign does not control. The Campaign is not responsible for the content, practices, or availability of any third-party sites or services.
Disclaimer of Warranties
The Site and all content, materials, and services provided through it are offered on an “as is” and “as available” basis without warranties of any kind, either express or implied. The Campaign does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
The Campaign makes no representations or warranties regarding the accuracy, completeness, or reliability of any information on the Site. Campaign positions, event details, and other information are subject to change without notice.
Limitation of Liability
To the fullest extent permitted by applicable law, Destiny Wells for Congress and its officers, staff, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, your participation in any Campaign activities, or your reliance on any information provided through the Site.
Federal Election Commission Compliance
Destiny Wells for Congress is a federal campaign committee registered with the Federal Election Commission. All campaign activities, including fundraising, are conducted in compliance with applicable federal election laws and FEC regulations.

Indemnification
You agree to indemnify, defend, and hold harmless Destiny Wells for Congress and its officers, staff, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any applicable law or regulation.
Changes to These Terms
The Campaign reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Indiana.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
